Agreement to Terms
Welcome to Gencon. These Terms of Service ("Terms") form a binding agreement between you and Gencon ("Gencon," "we," "us," or "our"), a family-owned remodeling and construction company based in Clackamas, Oregon, founded by brothers Max, Alex, and Oleg.
By accessing our website, requesting an estimate, or engaging Gencon for remodeling services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Project-Specific Contracts Govern These Terms are general in nature. Every Gencon project is governed by a separate, signed written contract that includes detailed scope, pricing, payment schedule, and warranty terms specific to that job. In any conflict between these Terms and your project contract, the project contract controls.
Description of Services
Gencon provides residential remodeling and construction services to homeowners throughout Clackamas County, Oregon. Our services include but are not limited to:
- Kitchen remodeling and renovation
- Bathroom remodeling
- Accessory Dwelling Unit (ADU) construction
- Basement finishing
- Flooring installation
- Home additions
- General remodeling and design-build services
The specific scope of work for any project is defined in the signed contract for that project. Service availability may vary by location within our service area.
Estimates & Project Proposals
Gencon offers free, no-obligation in-home estimates. An estimate is a good-faith projection of project cost based on the information available at the time of the visit. Estimates are not contracts and do not bind either party.
A formal written proposal may follow an estimate and includes a detailed scope of work, materials specifications, projected schedule, and itemized pricing. Proposals are typically valid for thirty (30) days from issuance unless stated otherwise. Material prices, subcontractor availability, and labor costs may change after this period.
Until a contract is signed and any required deposit is received, Gencon is not obligated to perform any work, reserve any time, or hold any pricing.
Project Contracts
All remodeling work performed by Gencon is governed by a written contract signed by both parties before work begins. The contract sets forth the scope of work, materials, schedule, total price, payment milestones, warranty, and any other agreed-upon terms.
Verbal agreements, sales conversations, marketing materials, website content, and these Terms do not modify the contract unless incorporated in writing. Clients are encouraged to read the contract carefully and ask questions before signing.
Pricing & Payment
Project pricing is determined per job and stated in the contract. Most projects use a milestone-based payment schedule with an initial deposit, progress payments tied to completion of defined phases, and a final payment due upon substantial completion and walkthrough.
Accepted Payment Methods
Gencon accepts payment by check, ACH transfer, and other methods specified in your contract. Payment processing fees, if any, will be disclosed in advance.
Late Payments
Payments are due on the dates specified in the contract. Late payments may pause work, delay subsequent milestones, and accrue interest or fees as permitted under Oregon law and as detailed in the contract. Gencon retains all rights under Oregon's construction lien statutes for unpaid balances.
Change Orders
Remodeling projects sometimes evolve once work begins — clients may request additional scope, hidden conditions may be uncovered, or material selections may change. Any modification to the original scope, materials, schedule, or price must be documented in a written change order signed by both parties before the modified work proceeds.
Change orders may affect the project price and timeline. Gencon will provide a clear estimate of the impact of any change order before requesting approval. Verbal agreements to changes are not binding.
Project Schedule
Projected start and completion dates are good-faith estimates based on typical project conditions, material lead times, and subcontractor availability at the time of contract signing. Gencon makes every effort to keep projects on schedule, but certain factors are outside our control, including:
- Material backorders, shipping delays, or supplier issues
- Permit and inspection wait times
- Weather conditions affecting exterior or weather-sensitive work
- Discovery of hidden site conditions (rot, code violations, structural issues, etc.)
- Client-driven changes, selections delays, or approval delays
- Force majeure events
Schedule adjustments arising from these factors do not constitute a breach of contract and do not entitle the client to discounts, refunds, or damages, except as expressly provided in the contract.
Client Responsibilities
For projects to proceed smoothly, clients agree to:
- Provide reasonable access to the work area during scheduled work hours
- Move or protect personal items in and around the work area before work begins
- Make timely material selections and decisions when requested
- Approve change orders, samples, or shop drawings within reasonable timeframes
- Maintain working utilities (water, electricity, etc.) at the project site
- Disclose known site conditions, easements, restrictions, or HOA requirements
- Make payments on the dates specified in the contract
Delays caused by unmet client responsibilities may extend the project schedule and may result in additional charges as outlined in the contract.
Permits & Code Compliance
Gencon is licensed to perform construction work in the State of Oregon and pulls all permits required for the scope of work in your project. Permit fees are typically passed through at cost and are itemized in your contract.
All work is performed in accordance with applicable Oregon state building codes, local Clackamas County ordinances, and city-specific requirements where applicable. Required inspections are scheduled with the appropriate jurisdiction, and Gencon coordinates inspector access during normal business hours.
Clients are responsible for disclosing any HOA, deed restriction, easement, or covenant requirements that may affect the project. Gencon is not responsible for HOA approvals or for work that violates restrictions not disclosed prior to contract signing.
Workmanship Warranty
Gencon stands behind its craftsmanship. We provide a written workmanship warranty on each project, with terms specified in your contract. This warranty covers defects in our installation work for the warranty period and obligates Gencon to repair or correct covered defects at no additional cost to the client.
Materials & Manufactured Goods
Manufactured products — appliances, plumbing fixtures, cabinets, countertops, flooring, windows, and similar items — are covered by the manufacturer's warranty. Gencon will assist clients in submitting warranty claims to manufacturers but is not the warrantor of those products.
Exclusions
The workmanship warranty does not cover damage caused by: normal wear and tear, settling or movement of the structure, water or weather damage from sources outside the project scope, modifications or repairs performed by others, lack of routine maintenance, misuse, accidents, or acts of God.
The warranty is non-transferable and applies only to the original client at the original project address unless otherwise stated in writing.
Insurance & Liability
Gencon maintains general liability insurance and workers' compensation coverage as required by Oregon law. Certificates of insurance are available upon request prior to project start.
Limitation of Liability To the maximum extent permitted by law, Gencon's total liability for any claim arising out of a project is limited to the total amount paid by the client under the project contract. Gencon is not liable for indirect, incidental, consequential, or punitive damages, including lost rental income, loss of use, or relocation costs, except where such limitation is prohibited by Oregon law.
Clients are encouraged to maintain their own homeowners insurance throughout the project. Personal property, valuables, and items not owned by Gencon should be removed from the work area or otherwise protected by the client.
Project Photography & Marketing
Gencon photographs completed projects for portfolio, marketing, and educational purposes. By engaging Gencon, you grant us permission to photograph the completed work and to use those photographs on our website, social media, printed marketing materials, and in proposals to other potential clients, subject to the following:
- We do not photograph people, personal items, identifying address details, or anything not directly related to the construction work without separate written permission.
- We do not disclose the specific street address of any client project in marketing materials.
- Clients may opt out of project photography by providing written notice prior to project completion.
If you do not wish to have your project photographed, please notify your project manager in writing.
Cancellation
Oregon law provides certain residential clients with the right to cancel a home improvement contract within three (3) business days of signing. Specific cancellation rights, deadlines, and procedures are stated in your contract and in the cancellation notice provided at signing.
Cancellation after the statutory period or after work has commenced may result in charges for work completed, materials ordered, custom items, design fees, and reasonable overhead, as detailed in the contract. Custom-ordered items (such as cabinetry, countertops, and special-order finishes) are typically non-refundable once ordered.
Website Use
The Gencon website is provided for informational purposes. By using the website, you agree to:
- Use the website only for lawful purposes
- Not attempt to gain unauthorized access to any part of the website
- Not interfere with or disrupt the website's operation
- Not scrape, copy, or reproduce content for commercial use without permission
Intellectual Property
All website content — including text, photographs, graphics, logos, and designs — is the property of Gencon or its licensors and is protected by United States copyright and trademark laws. Use of any content without express written permission is prohibited.
Third-Party Links
Our website may link to third-party sites or services. Gencon is not responsible for the content, accuracy, or practices of those external sites. Linking does not imply endorsement.
No Warranty on Website Content
Website content — including pricing examples, project timelines, and educational articles — is provided for general information only. Specific project recommendations, costs, and timelines are determined only through a written estimate and contract.
Dispute Resolution & Governing Law
These Terms and any project contract are governed by the laws of the State of Oregon, without regard to its conflict-of-laws provisions.
Good-Faith Resolution
We're a family-owned company, and we want clients to be happy with their finished project. If a concern arises during or after a project, please contact us first so we can address it directly. Most issues are resolved through a phone call or site visit.
Mediation & Arbitration
If a dispute cannot be resolved through good-faith discussion, the parties agree to attempt mediation through a mutually agreed-upon mediator in Clackamas County, Oregon, before initiating any legal proceeding, except where the dispute involves construction lien rights or where immediate injunctive relief is required. Specific dispute resolution procedures may be set forth in the project contract.
Venue
Any legal action arising out of or related to these Terms or a project contract shall be brought exclusively in the state or federal courts located in Clackamas County, Oregon, and the parties consent to the personal jurisdiction of those courts.
Changes to These Terms
Gencon may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Changes apply prospectively and do not modify the terms of any signed project contract. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
